LugarBet's AML Policy Lets It Restrict Withdrawals for Any Other Reason in Its Sole Discretion
Worse for players
Slightly NegativeThe LugarBet AML and KYC policy says: "We reserve the right to restrict the service, payment, or withdrawal until identity is sufficiently determined, or for any other reason in our sole discretion based on the legal framework." Documents can be requested at any time, and the check may ask for a government-issued photo ID, a selfie holding the ID and a bank statement or utility bill. The policy sets no deadline for sending them and no time for checking them. The second half of the restriction clause is not tied to verification at all, and the policy does not name the legal framework it points to.

What this means for players
The LugarBet AML and KYC policy is a short page in two parts: an anti-money-laundering statement that explains why accounts are verified, and a KYC section that sets out what can be asked for and what LugarBet may do while it waits.
- Restrictions for verification, or for any other reason. "We reserve the right to restrict the service, payment, or withdrawal until identity is sufficiently determined, or for any other reason in our sole discretion based on the legal framework." The first reason ends when identity is confirmed. The second has no end point the player can reach.
- Documents at any time. "The Company reserves the right, at any time, to ask for any KYC documentation it deems necessary to determine the identity and location of a user in Lugarbet." The list that follows is a government-issued photo ID, front and back for some documents, a selfie holding the ID, and a bank statement or utility bill. The request can come at any point in the life of the account, and the words any documentation it deems necessary leave the list open.
- Ongoing monitoring. LugarBet says it takes a risk-based approach, with strict due diligence checks and ongoing monitoring of all clients, customers and transactions. Verification is not a single event that a player completes once.
- No clock on either side. The policy gives no deadline for the player to send documents and no time for LugarBet to review them, and it does not say what happens to the balance if documents never arrive. Questions go to Support. A player cannot tell from the policy how long a restriction can last.
The documents are the ones most casinos ask for. The power is wider than the purpose: a policy written to confirm who a player is also reserves a right to restrict withdrawals for any other reason, and leaves unnamed the legal framework that reason rests on.

The LugarBet privacy policy states: "By logging in to the gaming site you give us the consent to collect and store the information on your location." The location is used to check that the player is not in a restricted country, and consent for certain processing activities is taken by a ticked box at registration or implicitly when you deposit. Player data may be checked against and shared with other online gaming sites, banks, credit card companies, fraud prevention agencies and sister casinos, and passed to Marketing Partners for email, post, SMS and telephone offers, though marketing is sent only with consent. On retention, the policy says only: "Generally, your personal data is retained for at least the duration of our relationship, and as required by the licensing authority." It sets a minimum for keeping the data and no maximum.
Under clause 21.4 of the LugarBet general terms, a dispute must be lodged within three days from the date the wager or event in question was decided, and "No claims will be honoured after this period." Clause 14.2 sets the same three days for any claim and limits LugarBet's total liability to the value of the bets involved or €500 in aggregate, whichever is lower. Withdrawals are capped at €10,000 a week, every deposit not linked to a bonus must be wagered once before it can be withdrawn, and an account closed for not complying with the terms may have its money withheld, deposit included. A player who spots a problem on the fourth day has no claim left, and one who claims in time can recover €500 at most.
