Megapari Rules Out Liability for Withholding Payments It Considers Suspicious
Worse for players
NegativeMegapari's KYC policy lets it request identity and address documents when a player reaches a certain sum of deposit or withdrawal, a figure it never states, and in some cases proof of funds, a selfie with ID and, during an investigation, the original documents. Confirmation of the player's phone number is mandatory. Where it finds signs of fraud or suspicious transactions, the company reserves the right to block or close the account, cancel any payments and suspend operations until the end of the investigation, and the policy states that refusing or withholding transactions it considers suspicious is no ground for its civil liability. A player cannot tell from the policy when a check will start or how long it will last, and the policy rules out a claim when it ends in a withheld payment.

What this means for players
Megapari's KYC policy is about 4,200 characters long and sets out three things: which documents the company accepts, when it asks for them, and what it may do during an investigation. The document list is ordinary. The triggers and the investigation powers are where the player's position is decided.
- A trigger sum that is never stated. "The documents quoted hereinabove can be requested when player reaches certain sum of deposit/withdrawal and when we suspect player in fraudulent activity." Online verification tools come first, and documents are requested where those cannot satisfy the criteria. The trigger has a sum attached, and the policy never says what the sum is.
- The ID has to match the profile exactly. Accepted ID is a driving licence, identity card, travel document or passport, or any other document designated by the Ministry of Finance of Anjouan, and the name, photograph, date of birth and citizenship on it must completely coincide with the player's profile. Documents are checked for signs of editing, a selfie with ID can be requested, and confirmation of the phone number is mandatory. A detail entered differently at registration is enough for a document to fail the criteria.
- Proof of funds, and the originals during an investigation. "In some cases we require additional proof - proof of funds (to make sure player uses his/her own money when gamble at our site)." During an investigation the company may ask for copies of the bank cards used to deposit, payment documents and documents confirming the lawful possession and legal origin of the funds. "The Company also has the right to request the original documents." The policy does not say how originals are delivered or when they are returned.
- An investigation with a start and no length. Where it finds suspicious transactions, deposits where the sender's details do not match the account holder's, or signs of fraud such as refunds and cancelled payments, the company reserves the right to conduct an internal investigation, block or close the account, cancel any payments and suspend operations on the account until the end of the official investigation. The account can stay suspended for as long as the investigation runs, and the policy gives it no deadline.
- Withdrawing by a different method opens questions. "The Company has the right to request additional information about the Customer if the withdrawal method is different from the deposit method." A player who refuses the request can have the account blocked for the duration of the investigation. Choosing a different way out from the way in is, on its own, enough for the company to ask for more information about the player.
- Winnings checked with the game provider. "In case we are not sure about the legality of the winning credited we contact provider and check those bets with them." Whether a credited win stands can depend on a check with a third party the player never deals with.
- No liability for a withheld payment. "The Company’s refusal or withholding to perform transactions which are considered by the Company as suspicious (including the blocking or closing of the Customer’s account) does not constitute to be a ground for civil liability of the Company for failure to fulfil obligations to the Customer." The policy turns a payment held back on the company's own suspicion from a failure to pay into the exercise of a right.
The policy is clear about what the company may ask for and what it may do. It is silent on the three things a player would need to plan around: the sum that starts a check, how long an investigation lasts, and what remedy is left if the suspicion proves wrong.
